Please read this privacy policy carefully to understand how your personal data is collected, processed, and stored when you use this website, accessible at http://www.talkspirit.com (hereinafter the "Site").

For the purposes of this privacy policy, the data controller responsible for the collection and processing of your personal data is Talkspirit (hereinafter "Talkspirit " or "we "), a simplified joint-stock company with a capital of 16,000 euros, having its registered office at 60, rue François 1er in Paris (75008), registered with the Paris Trade and Companies Register under identification number 479 109 332.

We reserve the right to modify, supplement, or replace the provisions of this privacy policy. In the event of a significant change, we commit to displaying a notification regarding the update to this privacy policy on our Site.

1. What personal data do we collect?

A. Identification data

When you fill out a contact form on our Site, for example to try our platform, schedule a demo, subscribe to our newsletter, or for any information request, you will be asked to provide certain personal identification data that allows us to contact you (including name, email, organisation, and phone number).

B. Connection and browsing data on our Site

When you connect to the Site, and subject to your consent to the cookie that collects this information, we may, where applicable, identify the source site from which you arrived and the site to which you navigate when you leave our Site.

On this occasion, we may also collect your Internet Protocol (IP) address or certain information regarding your device's operating system or web browser. Finally, we may track your browsing data on our Site, which is information automatically recorded by our servers when you access or use the Site.

2. For what purposes and on what legal bases do we collect your personal data?

We collect, process, and store your personal data for the following purposes:

  • We collect your identification data to contact you, present our platform to you—via a demonstration if applicable—and also offer you, by email, advertising information about Talkspirit products and services tailored to your needs. This processing is based on your consent for us to contact you to answer your questions and send you commercial solicitations when you submit a contact request on our Site.
  • We collect your professional email address to send you our newsletter. This processing is based on your consent for us to periodically send you our newsletter when you request to subscribe to it on our Site.
  • We also collect your connection and browsing data related to your use of the Site in order to operate, protect, improve, and optimise our Site and our users' experience, for example, to personalise or otherwise adapt and improve the user experience on the Site. The processing of this usage data is therefore based on our legitimate interest in providing and improving the user experience on our Site.

3. Who will have access to your personal data?

Your personal data will only be accessible to authorised personnel within Talkspirit (employees, interns, and freelancers) and strictly for purposes necessary for their respective duties (primarily the sales department and the Site's technical support).

We may also be required to share your personal data with third parties in the following situations:

  • Your personal data will be transmitted to our hosting provider located in France, which enables us to provide access to the Platform.
  • Your personal data may also be made accessible to our external technical service providers who ensure the proper administration of our Site, including our technical support provider and our email routing provider.

All the aforementioned service providers will access your personal data in accordance with the contractual terms signed with our company and in compliance with applicable personal data protection regulations, without being able to derogate from the terms of this privacy policy.

Some of these service providers are also located in the United States, a third country not recognised by the European Commission as having an adequate level of protection for personal data. However, we have taken care to verify that these providers respect the confidentiality of your personal data and have entered into the European Commission's standard contractual clauses with them to govern this data transfer to the United States.

All personal data we collect is hosted within the European Union.

We retain your identification data following an appointment or contact request for a maximum period of three (3) years from our last contact with you.

  • The right to restrict the processing of your personal data (i) when you contest the accuracy of the collected personal data, for the period required to verify its accuracy; (ii) when, following processing established as non-compliant, you prefer the restriction of processing over the complete erasure of the data; (iii) when the personal data is no longer necessary for the purposes of processing but is still required for the establishment, exercise, or defence of legal claims; (iv) when you have objected to the processing and wish to restrict it while it is verified whether the legitimate grounds invoked are justified,
  • The right to data portability, allowing you to receive your personal data in a structured, commonly used, and machine-readable format, or to request that this personal data be transmitted to another data controller, provided that this portability request concerns personal data you have provided directly and that it does not infringe upon the rights and freedoms of third parties,
  • The right to object to the processing of your personal data for reasons relating to your particular situation; in such cases, the processing in question will be terminated unless there are compelling legitimate grounds that justify its continuation in accordance with applicable regulations,
  • The right to define directives regarding the storage, deletion, and disclosure of your personal data after your death,
  • Where the processing of your personal data is based on your consent, you also have the right to withdraw that consent at any time. This right can be exercised, for example, via the unsubscribe link included in our commercial email communications.
